These terms and conditions apply to the use of any area of our website. By accessing this website you agree to the terms and conditions sest out below, even if you do not make a purchase. By agreeing to these conditions you agree to indemnify Yay Games and our officers, directors, employees, agents and suppliers, harmless and immediately on demand, from and against all claims, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your personal information.
We take payment through Paypal which accepts most credit and debit cards including Visa, MasterCard, Maestro and American Express.
We are fully aware of our responsibilities to store any information you provide securely. We do not hold any payment details on our site. All payments are carried out via Paypal. When you proceed through their checkout, you will be directed to their secure payment gateway for authorisation and then returned to our site once payment has been confirmed. No-on at Yay Games has access to your credit/debit card number or account details.
All transactions carried out on our site are subject to validation checks and authorisation by the card/paypal issuer. If the issuer of your payment method refuses or does not authorise payment to us, we will cancel your order. We cannot be held liable for non-delivery. Any late cancellations of payment after delivery, ownership of goods will revert to Yay Games, and will be required to be returned. Legal recourse may be taken if you do not comply.
Yay Games reserves the right to alter or amend the specifications and/or prices of the products offered for sale or withdraw them completely without prior notice at any time. If we amend, alter or remove items or products, or if we refuse to process a transaction or decide to unwind or suspend any transaction after processing has begun, we will not be held liable by your or any third party.

Intellectual Property and Right to Use
The contents of our website, yaygames.uk, is protected by a mixture of copyright, trademarks, database and other intellectual property rights. You may retrieve and display the contents of our site on a computer screen, store such content in electronic form, on disk or print one copy of any such content for your own personal, non-commercial use. You agree not to otherwise reproduce, modify, copy or distribute, publish or use for commercial purposes any of the materials on this site without our written permission.
If any single part of these conditions should for whatever reason be considered unlawful, void or for any reason inapplicable, then than provision shall be severable from the Conditions and all the remaining provisions of the conditions will still apply in full.
If for any reason we agree to waiver a particular provision then this cannot be construed as a waiver of any proceeding or succeeding breech of any provision. Each and every provision of thee conditions should be considered as applicable and surviving even is for any other reason one or other of the provisions is held to be inapplicable or unenforceable in any circumstances.
This contract is only available in English. No other languages apply to this contract.
These conditions are governed in accordance with the laws of England and Wales. In accepting these terms and conditions you fully accept the sole jurisdiction of the courts of England and Wales.
By placing an order, you agree to the terms above. Your statutory rights are not affected.
We are confident that you will be delighted with any product purchased from us, but if you wish to return an item to us, then we’ll try to make it as easy as we can. Any item may be returned for any reason within 30 days of the date of receipt so long as it is unused, undamaged and in its original packaging. We will refund the price of the item less the cost of delivery to the purchaser. The cost of carriage to return the unwanted item to us will be at your cost. We recommend that returned items are sent by Recorded Delivery (or an alternative trackable delivery option), as we cannot be held responsible for goods lost in transit.
Sealed products must be returned in their original packaging, undamaged and unopened. Products not returned in this condition will be refunded up to 50% of their sale value. This does not apply to items being returned due to manufacturing faults or items received by the customer already damaged.
If your product arrives damaged, please contact us immediately. We may ask you for pictures/evidence to prove the damage has happened in transit. We will then assess and advise you of the next steps. We will keep you informed about the progress of any replacement items.
This does not affect your statutory rights.
Procedure for exchanging or returning an item
If you would like to request a return, please e-mail us at email@example.com outlining the item you would like to return, your original order details and the reason. Please tell us if you would like the product exchanged or refunded.
Please package the item securely for transit, using the original packaging if available, and remember to enclose all the items to make the product complete. We recommend that returned items are sent by Recorded Delivery) or an alternative trackable delivery option), as we cannot be held responsible for goods lost in transit.
Once we have received and processed the returned item we will process the refund (less the cost of original postage) or dispatch the replacement item. In the case of wrongly supplied or damaged goods we will refund your postage costs
Shipping and Delivery
We aim to dispatch orders within a week if the items are in stock. Orders will be dispatched via Royal Mail or, for larger orders, Hermes or another delivery company may be used. If your order is out of stock we will contact you to give you an expected timescale or the option to cancel your order or the part of the order that cannot be fulfilled at present if you would rather not wait.
What if my order doesn’t arrive? UK Delivery
Items should normally arrive within a few days of dispatch.
If it is less than 5 working days since the item was dispatched to you, then it’s probably on its way, but may have been held up.
If it has been between 5 and 14 days since dispatch, then it is officially delayed. Please check with your neighbours to see if a parcel has been left with them, check any outhouses you might have where mail may be left if it cannot fit through your letterbox and check to see if a note has been posted through your letterbox saying the item has been returned to the depot as undelivered and awaiting collection.
If it is more than 14 days since the item was dispatched to you, your item should be classed as lost. You must e-mail us clearly declaring that you have not received this item. We will use this e-mail as evidence in our claim for a lost item, and you may be contacted by the Royal Mail, or other delivery company used, in regard to this. When we receive your emailed declaration we will either send you a replacement or give you a refund. Please send us an e-mail to firstname.lastname@example.org stating your order details and confirming that you have never received the item as we will pursue the issue with the Royal Mail, or other delivery company, for compensation and your letter will be used as evidence.
Please note: we cannot refund or replace items that have been lost in delivery until after 14 working days have passed, and we cannot always offer refunds in these situations where we can provide proof of delivery.
Please allow additional time for your orders to arrive over a bank holiday. We suggest allowing an additional 2-3 days for your packages to arrive to allow for delays within the system
It may be possible to pre-order new releases or, items which are temporarily out of stock, from our website. Payment for the item will be taken at the time of the order. Pre-ordered items will be dispatched to you within a week of our receiving them. Pre-orders may be cancelled at any time up to 2 weeks before the listed release date, at which point you will receive a full refund, less 50p processing fee. Pre-orders cancelled less than 2 weeks before the listed release date will receive a full refund less 10% processing fee.
Orders outside the UK
We may be able to accept orders that request a delivery address outside of the UK, however, all our prices are shown in Great British pounds (GBP) and use the recognised ‘£’ symbol. All delivery prices shown are for delivery to a UK address only. Delivery prices for any address outside the UK will differ from those advertised and can be obtained by contacting us directly on email@example.com.
